Introduction to Legal and Regulatory Considerations

Sports betting is shaped by multiple industries—including sports, finance, marketing, and technology—as well as by law, regulation, and governance. In this module, we will discuss:

  • How the 2018 Supreme Court of the United States (SCOTUS) Murphy v. NCAA ruling reshaped the U.S. sports betting landscape and resulted in a largely state-by-state regulatory system;
  • The role of the U.S. Constitution in gambling regulation;
  • How sports betting operates within a broader legal, media, and commercial ecosystem;
  • The role of state gaming boards and commissions in oversight and consumer protection; and
  • How gambling-related harms intersect with the criminal justice system, enforcement practices, and treatment-diversion courts.

We will also explore how legal and regulatory approaches have the potential to both exacerbate and reduce harms to athletes, consumers, and communities.
