The draft written by Justice Samuel Alito indicated that the Supreme Court was preparing to overturn key judgments in Roe v. Wade and Planned Parenthood v. Casey. Roe v. Wade protected abortion for any reason up until viability. It additionally protected abortion past viability if there is a health exception, in which the health of a pregnant person is jeopardized. As it was decided by the US Supreme Court, it took precedence over all federal court cases, as well as over state court cases that involve a point of federal law. Thus it overrode any state laws banning abortion, such as Michigan’s 1931 criminal abortion law. Planned Parenthood v. Casey further expanded on the right to access.

Dobbs v. Jackson Women’s Health Organization was decided on June 24, 2022. The case was in regards to a Mississippi ruling that banned abortions after 15 weeks of pregnancy. This decision overturns Roe v. Wade, finding that there is not a constitutional right to abortion.
